1. Agreement to these terms

These Terms of Service govern your use of ToolBelt, a marketplace operated by Chidera Onyebu ("ToolBelt", "we", "us"). By creating an account or using the service you agree to these terms. If you do not agree, do not use ToolBelt.

2. What ToolBelt is — and is not

ToolBelt is a marketplace. We connect customers who need home and property work done with independent local workers who perform it. We provide the platform, the payment mechanism, and the trust and safety systems.

ToolBelt does not perform any of the work. We are not a cleaning company, moving company, or contractor. We do not employ, supervise, direct, or control the workers listed on the platform, and we do not guarantee the quality, safety, timing, or legality of any work performed.

Plainly: the contract for the work itself is between the customer and the worker. ToolBelt facilitates that relationship and handles the payment, but is not a party to the work agreement.

3. Eligibility

You must be at least 18 years old and legally able to enter contracts. Workers must be legally permitted to perform the work they offer in their jurisdiction, and must hold any license, permit, registration, or insurance that jurisdiction requires.

4. Your account

You must give accurate information and keep it current. You are responsible for activity under your account and for keeping your credentials secure. We verify phone numbers by SMS; you consent to receiving verification messages and transactional notifications about your jobs. One person, one account — accounts are not transferable.

You are an independent contractor, not an employee, partner, or agent of ToolBelt. Nothing here creates an employment relationship. You control how, when, and whether you work, and which jobs you offer on.

ToolBelt currently supports cleaning, moving, handyman work, furniture assembly, yard work, and painting. Electrical, plumbing, and HVAC work may not be offered or requested through the platform until our license-verification process is in place. Offering or requesting regulated work is a breach of these terms and may result in immediate termination.

11. Ratings, reviews, and your content

Ratings are double-blind: neither party sees the other's rating until both are submitted. Ratings and reviews must be honest and based on a real completed job.

You keep ownership of content you submit — job descriptions, photos, messages, reviews. You grant ToolBelt a non-exclusive, worldwide, royalty-free licence to host, display, and use that content to operate and promote the service. We may remove content that breaches these terms.

12. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law.

We vet workers before they can take jobs, but vetting is not a guarantee. We do not warrant the conduct, honesty, competence, or safety of any user. You are responsible for your own judgment about whom you allow into your property and whose work you accept.

13. Limitation of liability and indemnity

To the maximum extent permitted by law, ToolBelt is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service or from any interaction between users.

Our total aggregate liability for any claim relating to a job is limited to the greater of the service fee we received on that job or USD 100.

You agree to indemnify and hold ToolBelt harmless from claims, damages, and reasonable legal costs arising from your use of the service, your breach of these terms, work you performed or received, or your violation of any law or third-party right.

Some jurisdictions do not allow certain limitations of liability. Where that is the case, the limitations above apply only to the extent permitted, and nothing here limits liability that cannot lawfully be limited.

14. Disputes between users

Disputes about the work itself are between the customer and the worker. We will review the job record and may issue a platform refund, but we are not obliged to mediate and are not responsible for the outcome of any dispute between users.

15. Suspension and termination

You may close your account at any time. We may suspend or terminate an account that breaches these terms, poses a safety risk, or is suspected of fraud — with notice where practical, and immediately where necessary. Obligations for completed jobs, including payment and fees, survive termination.

16. Changes to these terms

We may update these terms. Material changes will be notified by email or in-app before they take effect. Continued use after that constitutes acceptance. The "last updated" date above always reflects the current version.

17. Governing law

These terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law rules. Courts located in Prince George's County, Maryland have exclusive jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings locally.
